Customer Terms of Service

Welcome to WashPot ("WashPot", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the WashPot mobile application, website, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service.

1. About WashPot

WashPot is an online marketplace that enables customers to discover, schedule, and book vehicle washing services offered by independent service providers.

WashPot facilitates bookings between customers and service providers but is not itself a vehicle washing service provider.

2. Eligibility

To use the Service you must:

• Be at least 13 years of age.
• If under 18 years of age, use the Service only with the consent or supervision of a parent or legal guardian.
• Provide accurate and complete registration information.
• Maintain the confidentiality of your account credentials.

You are responsible for all activities that occur under your account.

3. Creating an Account

To use certain features of the Service you must create an account. You agree to:

• Register using accurate information.
• Verify your email address through the verification process.
• Keep your information updated.
• Maintain a secure password.
• Notify WashPot immediately if you believe your account has been compromised.

WashPot may suspend or terminate accounts that contain false or misleading information.

4. Using the Service

The Service allows customers to:

• Search for nearby service providers.
• View available vehicle washing services.
• Schedule bookings.
• Manage saved addresses.
• Upload a profile picture.
• Submit ratings and reviews.
• Manage account information.

Features available may change over time.

5. Customer Responsibilities

When using WashPot you agree to:

• Provide accurate booking information.
• Provide an accurate pickup or service location.
• Be available during the scheduled booking window.
• Cooperate with the assigned service provider.
• Treat service providers respectfully.
• Ensure reasonable access to the vehicle.

Failure to provide accurate information may result in delays or cancellation of services.

6. Booking Requests

Submitting a booking request does not guarantee completion of the requested service. Bookings remain subject to:

• Service provider availability.
• Operational constraints.
• Technical issues.
• Other circumstances beyond WashPot's reasonable control.

WashPot reserves the right to reject incomplete or invalid booking requests.

7. Pricing and Payments

At the effective date of these Terms, online payment functionality is not available within the WashPot application.

Current booking functionality is provided for MVP purposes and may not represent final commercial operations.

Future versions of WashPot may integrate third-party payment gateways to facilitate secure online payments. WashPot does not store complete debit card, credit card, or banking credentials.

Payment processing terms may change when online payment functionality becomes available.

8. Cancellations

Customers may cancel bookings in accordance with the cancellation options available within the application. Repeated abuse of booking or cancellation functionality may result in account restrictions. Cancellation policies may be updated as the Service evolves.

9. Refunds

The current MVP does not process online payments. Accordingly, refund functionality is not presently available.

When online payments are introduced in future versions of the Service, WashPot will publish a separate Refund and Cancellation Policy describing applicable eligibility and procedures.

10. Reviews and Ratings

Customers may submit ratings and reviews based on genuine service experiences. You agree that reviews will:

• Be truthful.
• Be based on actual experiences.
• Not contain abusive, defamatory, hateful, discriminatory, or unlawful content.
• Not contain spam or promotional material.

WashPot reserves the right to remove reviews where required by law or where necessary to protect the integrity of the Service.

11. Prohibited Conduct

You agree not to:

• Create fraudulent bookings.
• Submit fake reviews or ratings.
• Impersonate another person.
• Use false identity information.
• Harass, threaten, or abuse service providers or other users.
• Upload unlawful or offensive content.
• Attempt to gain unauthorised access to the Service.
• Reverse engineer, decompile, or otherwise attempt to extract source code from the application except where permitted by applicable law.
• Use automated scripts, bots, crawlers, or scraping tools without prior written permission.
• Interfere with the security or operation of the Service.
• Violate any applicable laws or regulations.

Violation of these Terms may result in suspension or permanent termination of your account.

12. User Content

You retain ownership of the content you submit, including profile photographs, reviews, ratings, and feedback.

By submitting content, you grant WashPot a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and use such content solely for operating, improving, and promoting the Service.

You represent that you have the necessary rights to submit such content.

13. Intellectual Property

The WashPot application, branding, logos, software, text, graphics, and related materials are owned by or licensed to WashPot and are protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of intellectual property to users. You may not reproduce, modify, distribute, or commercially exploit any part of the Service without prior written permission.

14. Privacy

Your use of the Service is also governed by the WashPot Privacy Policy. By using the Service, you consent to the collection and processing of your information as described in the Privacy Policy.

15. Third-Party Services

WashPot may rely on third-party providers including cloud storage, mapping services, geocoding services, email providers, and future payment gateways. These third parties operate under their own terms and privacy policies. WashPot is not responsible for services provided directly by independent third parties.

16. Marketplace Disclaimer

WashPot operates solely as a technology platform connecting customers with independent vehicle washing service providers. Unless expressly stated otherwise:

• WashPot does not employ service providers.
• WashPot does not guarantee the quality, availability, or suitability of services provided by independent providers.
• The service provider remains responsible for performing the booked service.

17. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, WashPot disclaims all warranties, whether express or implied, including warranties relating to merchantability, fitness for a particular purpose, non-infringement, availability, reliability, and accuracy.

WashPot does not guarantee uninterrupted or error-free operation of the Service.

18. Limitation of Liability

To the maximum extent permitted by law, WashPot shall not be liable for indirect or consequential damages, loss of profits, loss of data, loss of business opportunities, delays caused by service providers, damage arising from services performed by independent service providers, or events beyond WashPot's reasonable control.

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

19. Suspension and Termination

WashPot may suspend or terminate access to the Service where a user violates these Terms, engages in fraudulent activity, attempts to compromise platform security, misuses the Service, or creates risk for other users or the platform.

Users may request account deletion through the application or by contacting WashPot. Certain operational records may be retained in accordance with the Privacy Policy.

20. Future Features

WashPot may introduce new functionality including online payments, push notifications, loyalty programmes, additional booking options, iOS application support, and other marketplace features. Availability of future features is not guaranteed.

21. Changes to these Terms

WashPot may update these Terms from time to time. Material changes will be communicated through the application, website, email, or other appropriate means. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

22. Governing Law

These Terms shall be governed by the laws of India.

23. Jurisdiction

Any dispute arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts located at Mangaluru, Karnataka, India.
